Terms & Conditions of Tick Tock Tutoring PTY Ltd
1.1) Your use of our centre, its services and programmes will be governed by these terms and conditions. These terms and conditions constitute an agreement between yourself and Tick Tock Tutoring PTY Ltd.
1.2) Tick Tock Tutoring PTY Ltd may amend these terms and conditions from time to time. By accessing our centre and technology services you are bound to the terms and conditions published in this document at the time of any visit to and/or usage of our centre.
1.3) A certificate signed by the administrator responsible for maintaining the website will be prima facie proof of the date of publication and content of the current version and all previous versions of the terms and conditions.
2.) CORRECTNESS OF SUPPLIED INFORMATION
2.1) By signing this agreement you hereby permit Tick Tock Tutoring PTY Ltd and its online partners to rely on the fact that:
2.1.1) all your given details are true and correct;
2.1.2) you are legally capable of concluding any transaction on this agreement;
2.1.3) you have read, understood and accepted these terms and conditions
2.2) Tick Tock Tutoring PTY Ltd must be entitled to rely on instructions that appear to originate from you even if they come from someone else impersonating you and unless you notify us of any irregularities, to act on any instruction purporting to originate from you.
3.) NATURE OF INFORMATION ON THE SITE
All material on the website merely constitutes an invitation to do business unless otherwise expressly stated and is not an offer to enter into any transaction.
4.) TERMINATING REGISTRATION OR USE OF OUR SERVICES
4.1) Tick Tock Tutoring PTY Ltd may in its sole discretion and at any time discontinue providing the use to our centre or programmes and other services or any part thereof, with or without notice.
4.2) For our services provided that are appointment based, we do follow a formal cancellation policy, which means that clients cannot cancel an appointment without financial implications 6-12 hours before the appointment.
4.3) Lessons that are cancelled less than 2 hours before the booked and confirmed lesson start time will be charged a cancellation fee of R 60.00 We consider any late lesson resulting in a 15-minute delay from the confirmed lesson start time without any form of notice as a no-show and will be charged the cancellation fee stated. Late arrivals will affect the lesson duration as the time slot will not be moved later and the lesson will end at the time captured on the booking system.
5.) LINKED THIRD-PARTY CONTENT
5.1) Tick Tock Tutoring PTY Ltd, its contractors, agents, owners and employees are not responsible for the contract or privacy policies of any websites to which it may link.
5.2) Tick Tock Tutoring PTY Ltd shall not be liable in any manner whatsoever for any loss or damage that you may suffer as a result of the use of our tutoring centre, programs and services.
Access to the services, content, software and content downloads available from Tick Tock Tutoring PTY Ltd is classified as “electronic transactions” in terms of the Electronic Communications & Transactions Act 25 of 2002 (“ECT Act”) and therefore users have the rights detailed in Chapter 7 of the ECT Act and Tick Tock Tutoring PTY Ltd has the duty to disclose the following information:

6.12) Alternative dispute resolution: Subject to urgent and/or interim relief, all disputes regarding:
6.12.1) access to the Tick Tock Tutoring PTY Ltd website;
6.12.2) the inability to access the Tick Tock Tutoring PTY Ltd website;
6.12.3) the services and content available from the Tick Tock Tutoring PTY Ltd website; or
6.12.4) these terms and conditions shall be referred to arbitration in terms of the expedited rules of the Arbitration Foundation of South Africa and such arbitration proceedings shall be conducted in English. The arbitration ruling shall be final, and the unsuccessful party shall pay the costs of the successful party on a scale as between attorney and own client.
6.13) Cooling off period: In terms of the operation of section 42(1)(d) of the ECT Act, the cooling off provisions of the ECT Act do not apply to this website; and
6.14) Users may lodge complaints concerning Tick Tock Tutoring PTY Ltd website through the “Contact Us” service provided on this website. These results are based on the client or customer committing to certain actions provided as both parties are required to follow all the guidance provided. Our results are produced under “typical” circumstances and require a commitment from the customer.

The terms and conditions pertaining to any services appearing on these pages shall be governed and interpreted in accordance with the laws of the Republic of South Africa and application for any of the services offered on these pages or at our centre/ communication tools will constitute your consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted by either party against the other, arising from any of the terms and conditions pertaining to such services.
9.1) Tick Tock Tutoring PTY Ltd shall take all reasonable steps to protect the personal information of tutors and clients and for the purpose of this clause “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).
9.2) Tick Tock Tutoring PTY Ltd may electronically collect, store, use and other, the following information of users:
9.2.1) name and surname;
9.2.2) contact details;
9.2.3) email address; and
9.2.4) results and reporting
9.3) Tick Tock Tutoring PTY Ltd collects, stores and uses the above-mentioned information for the following purposes:
9.3.1) communicate requested information to the user;
9.3.2) registration and/or authentication of users; and
9.3.3) to compile non-personal statistical information about browsing habits and access to the Tick Tock Tutoring PTY Ltd website, social platforms and communication tools

Any use of materials given to you by Tick Tock Tutoring PTY Ltd not expressly authorized is strictly prohibited and constitutes unlawful infringement of the intellectual property rights of Tick Tock Tutoring PTY Ltd.
10.2) Tick Tock Tutoring PTY Ltd will not be held responsible for any mistakes, omissions, interruptions or delays about the content or any damage resulting therefrom.
Tick Tock Tutoring PTY Ltd may in its sole discretion terminate your access to our centre and services, cancel all booked lessons or exercise any other remedy available if it believes that your conduct is in breach with or inconsistent with these terms and conditions.
Tick Tock Tutoring don’t give refunds, as it is service based, and we require that if a customer is not satisfied with a task that was assigned, they bring this to our attention, so we can come to an amicable resolve.
